These Terms of Use govern the use of the website hobihostel.com and the relationship between Hobi Hostel Boutique and its guests. By booking a stay or browsing the website, you agree to these terms. The processing of personal data is governed by our Privacy Policy, in the section right below these Terms.

1. About Hobi Hostel Boutique

Hobi Hostel Boutique is a hospitality establishment located in a historic mansion protected as a heritage site by CONPRESP, at Rua Rui Barbosa, 595, Bela Vista (Bixiga), São Paulo, Brazil. Bookings can be made through our website (hobihostel.com), via WhatsApp (+55 11 96511-6184), or through our partner online travel agencies.

2. Bookings and payment

  • We accept payment in Brazilian reais (BRL), credit/debit card, and PIX.

  • Bookings made outside our direct website (via OTAs) are also subject to the respective platform's terms.

  • Special group rates can be negotiated directly via WhatsApp.

3. Check-in, check-out, and mandatory guest registration

  • Check-in: from 2:00 PM. Check-out: by noon.

  • 24-hour reception — we ask that you let us know your estimated arrival time in advance.

  • Service available in Portuguese, English, and Spanish.

  • Luggage storage before check-in and after check-out is available for guests with a confirmed reservation.

  • As required by Brazil's General Tourism Law and the applicable Ministry of Tourism regulation, every guest must complete the Digital National Guest Registration Form (FNRH), via check-in at gov.br, before or upon arrival. This can be completed by the guest (with or without a gov.br account) or, if necessary, by our front desk team.

  • Guests under 18 are only accepted when accompanied by a legal guardian or with proper authorization documentation.

4. Cancellation

Each reservation's cancellation policy follows the rate selected by the guest at the time of booking, always in strict compliance with the Brazilian Consumer Protection Code (Código de Defesa do Consumidor, Law No. 8,078/1990), including the right of withdrawal applicable to purchases made outside a physical business establishment. Advance charges, when applied, are at Hobi Hostel Boutique's own commercial discretion, and the specific conditions of each rate are disclosed to the guest at the time of booking. Bookings made through partner online travel agencies also follow the cancellation policy stated on that platform.

5. House rules

  • We are not a "party hostel": quiet hours are strictly observed between 10:00 PM and 8:00 AM.

  • We ask for mutual respect among guests and staff, with special care given that this is a listed historic building.

  • Pets are accepted only in Private Rooms 2 and 3 (garden level), subject to an additional fee and under the owner's full responsibility and supervision.

  • Guests are responsible for any damage caused to the property, furnishings, or third-party belongings during their stay.

  • Hobi Hostel Boutique reserves the right to ask guests who violate these rules to leave, with no refund for the portion of the stay already used.

6. Property characteristics

As a listed historic mansion, the building has particularities guests should be aware of before booking:

  • There is no air conditioning (a heritage-preservation restriction); rooms are equipped with fans and natural ventilation.

  • There is no on-site garage or parking, though nearby options are available.

  • Towels are provided. Breakfast is included, with a vegan option available upon advance request (ideally confirmed a day ahead).

  • The building has no street-number plaque on its façade (pending municipal authorization for façade changes); guests should look for its exposed-brick façade, unique on the street, to find it.

7. Liability

Hobi Hostel Boutique is not responsible for valuables left unattended in common areas. We recommend using the storage options offered at reception. Our liability as a hospitality service provider is governed by the limits set out in the Brazilian Consumer Protection Code (Law No. 8,078/1990) and applicable civil law.

8. Intellectual property

All content on hobihostel.com — text, photos, the "Hobi Hostel Boutique" brand, and visual identity — belongs to Hobi Hospedagem e Entretenimento LTDA or is used under license; reproduction without prior authorization is prohibited.

9. Privacy

The collection, use, and sharing of personal data of guests and website users — including the mandatory submission of data to the Ministry of Tourism via check-in at gov.br — are described in detail in our Privacy Policy, in the section right below, which forms an integral part of these Terms of Use.

10. Changes to these terms

We may update these Terms of Use from time to time. The date of the last update will always be shown at the top of this document.

11. Governing law and jurisdiction

These Terms of Use are governed by the laws of the Federative Republic of Brazil. The courts of the city of São Paulo/SP are elected as the venue for resolving any disputes, without prejudice to the consumer's right to choose the venue of their own domicile, under the Brazilian Consumer Protection Code.

This Privacy Policy explains how Hobi Hostel Boutique collects, uses, stores, and shares the personal data of guests and users of the website hobihostel.com, in accordance with Brazil's General Data Protection Law (Lei nº 13.709/2018 — LGPD).

1. Who controls your data

  • Payment data: processed through the payment methods used (card, PIX); we do not store full credit card data in our own systems.

  • Browsing data: cookies and identifiers collected on the website via Google Analytics/Google Tag Manager and the Meta Pixel, to measure performance and advertising (Google Ads, Meta Ads).

About the submission to the Ministry of Tourism

As of April 20, 2026, every hospitality establishment registered with Cadastur — including hostels — is required, under Brazil's General Tourism Law and the applicable Ministry of Tourism regulation, to complete the Digital National Guest Registration Form (FNRH) for each guest, via check-in at gov.br. This can be completed by the guest themselves (with or without a gov.br account) or by the establishment. This submission is a structural, mandatory part of the booking process, treated in this policy as compliance with a legal obligation.

Data submitted via the Digital FNRH is stored on federal government servers, in partnership with SERPRO, under LGPD rules as applied to public administration — long-term custody of these records belongs to the government, not to Hobi Hostel Boutique.

4. Who we share your data with

  • Our hotel management system (PMS) — a technology platform, based abroad, that we use to record bookings and guest data, and which acts as a data processor on our behalf.

  • Ministry of Tourism / SERPRO — as described in item 3, in compliance with a legal obligation.

  • Partner online travel agencies (OTAs) — when your booking is made through an online travel agency we partner with, the data necessary for the booking is shared with that platform, which has its own privacy policy.

  • Advertising and traffic-analysis tool providers — via cookies and tracking pixels, for traffic analysis and advertising purposes.

We do not sell personal data to third parties.

5. International data transfers

As our hotel management system is based outside Brazil, your data may be transferred internationally to enable the provision of the hospitality service. We seek, with our vendors, contractual and technical safeguards compatible with Article 33 of the LGPD for these transfers.

6. How long we keep your data

Data submitted via the Digital FNRH remains in the federal government's custody, as described in item 3. Other booking and stay data, stored in our hotel management system, is automatically anonymized 180 days after check-out — a period set to cover the window during which a payment can be disputed with the card issuer. After this period, name, email, phone number, ID document number and issuing details, and files attached to the guest profile are deleted or replaced, keeping only the birth month/year and an operational record of the stay with no personal identification. You may request early deletion of your data at any time, under item 7.

7. Your rights as a data subject

You may, at any time, request:

  • confirmation that we process your data, and access to it;

  • correction of incomplete, inaccurate, or outdated data;

  • anonymization, blocking, or deletion of unnecessary data or data processed in violation of the law;

  • portability of your data to another provider;

  • deletion of data processed on the basis of your consent;

  • information about who we share your data with;

  • withdrawal of consent and objection to processing based on legitimate interest.

Requests can be made by email to reservas@hobihostel.com. We will respond within the timeframe set by the LGPD.

8. Cookies

The website hobihostel.com uses cookies and similar tools (Google Analytics, Google Tag Manager, Meta Pixel) to understand how visitors use the site and to measure advertising campaign performance. You can manage or disable cookies directly in your browser settings.

9. Information security

We adopt reasonable technical and administrative measures to protect your data against unauthorized access and against destruction, loss, alteration, or leakage. No system is 100% immune to incidents; should a significant incident occur, we will notify affected data subjects and Brazil's National Data Protection Authority (ANPD), as required by law.

10. Changes to this policy

We may update this policy from time to time. The date of the last update will always be shown at the top of this document. Material changes will be communicated by email or a notice on the website.
